Legal notice & privacy

The important small print, in plain English.

No legal advice

The content of this website is general information about Turkish law, written for foreigners considering a compensation claim. It is not legal advice, and it cannot account for the facts of your particular situation. You should not act, or refrain from acting, on the basis of anything here without taking advice on your own case.

No lawyer–client relationship

Reading this site, or sending us an enquiry through it, does not by itself create a lawyer–client relationship. That relationship begins only when we have confirmed we can act for you, any conflict checks are complete, and an engagement is agreed in writing.

Regulatory information

Restitora is the practice name under which work is carried out by lawyers admitted to the Turkish bar. The lawyers responsible for the content of this site are:

  • Av. Onur Çalışıcı — İstanbul Barosu, Sicil No. 83426
  • Av. Oruç Aygün — İstanbul Barosu, Sicil No. 83427

Both are admitted to practise in Türkiye and are subject to the Attorneys Act (Avukatlık Kanunu, Law No. 1136), the professional rules of the Union of Turkish Bar Associations (Türkiye Barolar Birliği) and the supervision of the Istanbul Bar Association. Professional practice is based in Istanbul, with instructions accepted for matters throughout Türkiye. This website is intended as permitted professional information, not as advertising or solicitation.

Privacy & your data

When you contact us, we collect the details you choose to send (such as your name, email, country and a description of your enquiry) so that we can assess it and reply. We use this information only for that purpose and for any engagement that follows.

  • Lawful basis & rights. We handle personal data in line with Turkish data-protection law (KVKK, Law No. 6698) and, where it applies, the EU GDPR. You can ask what we hold, ask us to correct or delete it, and object to certain uses.
  • The tick-box on the contact form. It confirms you have read this notice — which is what art. 10 of KVKK (Law No. 6698) requires us to give you at the point your details are collected: who we are, why we are asking, where the message goes, how and on what legal ground it is collected, and the rights art. 11 gives you. It is not the “explicit consent” (açık rıza) of art. 5(1), and ticking it commits you to nothing: it records only that you were told these things before sending.
  • Confidentiality. Enquiries are treated as confidential, subject to our professional duties.
  • Retention. We keep enquiry data only as long as needed for the purpose above or as the law requires.
  • Contact. For any data request, email hello@restitora.com.
Where your enquiry actually goes. When you submit the contact form, your message is sent from your own browser to Web3Forms, a form-delivery service, which turns it into an email to the practice’s office inbox (info@lexinlegal.com) and handles it only in order to deliver it. It is not published, and it is not passed on for any other purpose. If that delivery does not go through, the page says so rather than claiming your message arrived: it is then assembled in your own browser and you choose whether to send it by WhatsApp or by email. Either way a copy stays in your own browser so you do not lose what you typed. If you would rather not use the form at all, write to hello@restitora.com or message us on WhatsApp instead — those reach us directly.
That delivery step may sit outside Türkiye. Web3Forms is an independent service and its servers may be located abroad, so submitting the form can mean your details leave Türkiye. We are telling you this so the choice is yours: the WhatsApp and email routes above do not use it. Where personal data is transferred abroad, art. 9 of KVKK (Law No. 6698, as amended on 2 March 2024 by Law No. 7499) sets out when that is permitted — one of the grounds in art. 5 or 6 together with an adequacy decision (yeterlilik kararı) for the destination, which the Board gives and publishes in the Official Gazette; failing that, one of the safeguards listed in art. 9(4), such as the Board’s standard contract, provided you can still exercise your rights and reach an effective remedy there; and failing those, for occasional transfers only, one of the situations in art. 9(6), which include your explicit consent after being told of the possible risks, and a transfer that is necessary to perform a contract with you or to take pre-contractual steps you asked for. The same safeguards follow the data into any onward transfer (art. 9(8)).

Cookies & analytics

Until 30 September 2026 this site set no cookies at all. It now loads Google Analytics 4 (measurement ID G-CRQFVYE774) so that we can see which pages visitors actually use — but only if you accept it first. There is no advertising, remarketing or profiling tag on this site: the advertising permissions in the Google tag are switched off permanently, not just until you decide.

Nothing is stored on your device before you choose. The tag starts with every storage permission denied (Google Consent Mode). It is honest to add what that does and does not mean: before you decide, and also if you decline, the tag still tells Google that a page was viewed — but with no cookie and with a throwaway identifier that we measured changing from one page to the next, so those views cannot be joined up into a person or a returning visitor. Accepting is what permits the two cookies, and with them the ability to recognise that two visits are the same person:

CookieWhat it doesLifetime
_gaDistinguishes one visitor from another, so two visits by you are not counted as two people.2 years as documented by Google
_ga_CRQFVYE774Keeps the state of the current session.2 years as documented by Google

In practice browsers cut those lifetimes short: Google states a maximum of 400 days in Chrome and 7 days in Safari where a visitor does not return. Alongside the page views, we record when someone clicks the WhatsApp or email link and when an enquiry form is completed — as a count, with the page and which link it was, never the content of what you typed. Google Analytics also derives coarse location (city, region, country) from your IP address; for visitors in the EU, Switzerland and the UK Google states that it does not log or store the address itself. In the Analytics property, user-level and event-level data are kept for 14 months — the longest a standard property allows — and then deleted. Analytics data is not combined with an enquiry you send us, and it does not tell us who you are.

Legal basis, and where the data goes. These cookies are not needed to display the site, so we rely on your explicit consent (açık rıza) under KVKK, Law No. 6698, art. 5(1) — consent that art. 3(1)(a) requires to be specific, informed and freely given. Google processes the data on servers outside Türkiye, so accepting also means agreeing to that transfer. Transfers abroad are governed by art. 9 of the same law; here the transfer rests on the consent you give at the banner, after being told on this page what is sent and to whom. If you would rather nothing about your visit left Türkiye, decline — the site behaves identically either way, so declining is a real option and not a formality. Your rights over this data are the ones listed in art. 11 and are exercised at hello@restitora.com.

You can change your mind at any time, and it takes one click. Declining means the two cookies are never set at all; switching off later deletes them. Either way what remains is the cookieless signal described above, and nothing on this site works any differently.

One count does not depend on that choice. Separately from Google Analytics, and whether you accept or decline, tapping a phone, WhatsApp or email link on this site — or an enquiry form of yours being delivered — sends one short request to this same domain, and the address it asks for records nothing but which kind of link it was and which page you were on. The reply is empty. It sets no cookie, reads nothing from your device, carries no identifier and none of what you typed, and we do not keep your IP address. We count this because the analytics figures on their own cannot tell us whether the ways of contacting us here actually work: a visitor who declines is not in them.

This control needs JavaScript. With JavaScript switched off, no analytics cookie can be set in the first place.

Nothing else on this site stores anything on your device except the copy your own contact-form draft is saved as, in your own browser, so a mistyped send is recoverable — and the choices you make in notices like this one. Neither reaches us. Typefaces are served from this domain, so no request goes to Google Fonts.
